THIS IS NOT A CONTEST AND THERE IS NO PRIZE.
Aramara Beauty LLC dba Glow Recipe (“Glow Recipe”) is launching our 2024 DEW YOU anonymous casting campaign, open to residents of the continental United States and the European Union. We’ll be choosing passionate Glow Recipe fans from our community based entirely on their personality and inner beauty (that’s right, we won’t see what you look like!) to star in a new brand campaign the (“Campaign”). Semi-finalists will be selected sight unseen out of all applicants based on your responses to the questionnaire in the application instructions below. We’ll then narrow the semi-finalists through off-camera phone calls before selecting the final models for our Campaign. Our Diversity Advisory Board, an external committee of beauty experts from different backgrounds and experiences, will help review that selection to ensure that this process is as unbiased as possible, but also to ensure that our final selection features diverse members of our community. We will be prioritizing diversity in our final selection, not traditional beauty standards. Everyone is invited and encouraged to apply regardless of gender, gender identity, or gender expression.
If you’re comfortable speaking to camera and are interested in applying through this Anonymous Open Casting Call (“Casting Call”), please review the below Terms and Conditions (“Terms”), fill out the following questionnaire before midnight Eastern Standard Time (“EST”) on February 5, 2024 if you are eligible to apply, and make sure that you’re available during the dates listed in the section titled “Who Can Apply” below.
WHO CAN APPLY.
The Casting Call is open only to legal residents of the continental United States (including the District of Columbia, but excluding Alaska, Hawaii, and any protectorates or territories of the United States) and the countries that make up the European Union who: (i) have validly submitted an application as described below; (ii) are at least 18 years of age or older (at the time of application); (iii) are eligible to participate in the Campaign on a non-union basis and/or free of the requirement to pay agency fees if a professional model or otherwise represented by an agent or managed in relation to modeling; and, (iv) are available to participate in the following activities in connection with the Casting Call and, if selected, the Campaign: (a) February 26 – February 28, 2024: off-camera interview call to get to know you better (the “Casting Interview”), (b) March 13-March 15, 2024: on-camera call to inform Selected Participants (as defined below) of their selection to be participate in the Campaign and (d): travel to the Selected Participant’s assigned location in either New York City, NY (April 23 – April 24, for Selected Participants from the US) or Paris, France (March 24 – March 25, for Selected Participants from the EU) (if necessary) for a welcome dinner and to participate in the photo and video shoots for the Campaign.
The Casting Call is governed by the laws of the State of New York, United States and subject to all applicable federal, state, and local laws and regulations. If you are prohibited from participating in this Casting Call by any local laws, rules, or regulations, you may not apply. By participating in the Casting Call, you agree fully and unconditionally to these Terms and Glow Recipe’s decisions, which are final and binding in all matters related to the Casting Call. Eligibility to be selected for an invite to participate in the Campaign is contingent upon complying with and fulfilling all requirements set forth herein.
PARTICIPATION IN THIS CASTING CALL ONLY PROVIDES AN OPPORTUNITY FOR PARTICIPANTS TO BE CONSIDERED FOR AN INVITE TO PARTICIPATE IN THE CAMPAIGN. THIS CASTING CALL DOES NOT GUARANTEE THAT ANY PARTICIPANT WILL BE INVITED TO ANY FURTHER CALLS WITH GLOW RECIPE OR ANY ADVISORY PARTNER (DEFINED BELOW) OR TO PARTICIPATE IN THE CAMPAIGN. YOU UNDERSTAND AND AGREE THAT SPONSOR HAS THE RIGHT TO SELECT ANY PARTICIPANT IT CHOOSES (IF ANY) TO INVITE TO ANY CALLS WITH GLOW RECIPE AND/OR ANY OTHER ADVISORY PARTNER(S) AND/OR TO PARTICIPATE IN THE CAMPAIGN.
GENERAL INFORMATION.
The application period for this Casting Call opens at 12:00.00 PM EST on January 26, 2024 and ends at 11:59.59 PM EST on February 5, 2024 (the “Application Period”).
HOW TO APPLY.
During the Application Period, each participant (the “Participant”) must visit the application page at [https://glowrecipe.typeform.com/USapplication] (“Site”) if a resident of the continental US, or at [https://glowrecipe.typeform.com/EUapplication] (“Site”) if a resident of the European Union and submit all information requested in the application questionnaire, which includes your name, e-mail address, age, city and state and/or country of residence, ethnicity, and other information about you (“Application Information”). All Application Information and other information submitted by participant shall be collectively referred to herein as the “Submissions” or each a “Submission.” Limit one (1) Submission per person. No other method of participation will be accepted. Submissions that do not follow the requirements of these Terms may be disqualified at Glow Recipe’s discretion.
All deadlines are based on the Eastern Standard Time. All determinations of eligibility shall be final and binding. For the avoidance of doubt, Glow Recipe may or may not provide Participants with confirmation of Casting Call application.
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO APPLY OR BE ELIGIBLE TO RECEIVE A CALL BACK AND MAKING A PURCHASE OR OTHER PAYMENT TO GLOW RECIPE DOES NOT INCREASE YOUR LIKELIHOOD OF BEING SELECTED TO PARTICIPATE IN THE CAMPAIGN.
APPLICATION INFORMATION CONDITIONS AND RESTRICTIONS.
Glow Recipe will only use your Application Information to contact you for reasons relating to this Casting Call and otherwise in accordance with Glow Recipe’s privacy policy at https://www.glowrecipe.com/pages/privacy-policy. Please review these Terms and the Privacy Policy that carefully.
By participating in the Casting Call, you hereby agree to Glow Recipe’s collection and usage of any personal information included in the Submission for the purposes described above and acknowledge that you have read and accepted Glow Recipe’s privacy policy. Please note that information about your racial or ethnic origin is considered a special category of personal data under certain privacy laws. If you provide or disclose any information about your sexuality or sexual orientation, that information is also considered a special category of personal data under applicable privacy laws. By providing the requested Application Information, you agree that you are explicitly consenting to the processing of that personal data for the purposes described in these Terms.
SEMI-FINALIST DETERMINATION.
The decision as to which Participants will receive an invitation for an off-camera call as a semi-finalist will be made as follows:
A panel of representatives from Glow Recipe will review all Submissions properly submitted and received during the Application Period. The panel will choose Participants to invite to participate in a Casting Interview, in its sole discretion, taking into account only the information provided by the Participants in the Submissions. The Participants who are selected as the semi-finalists will be required to provide a photo (“Photo”) of themselves through a secure method that prevents the representatives from Glow Recipe from seeing the Photo. Instructions with respect to the required Photo and how to submit it will be provided at or around the time the Participants are invited for a Casting Interview, but Participants should expect to provide a headshot, looking straight into the camera, with a plain background, even lighting, and in .jpg/.jpeg format no larger than 3MB. When received, Glow Recipe will not use your Photo for any purpose other than evaluating your Submission, through the Advisory Partners, for ensuring that Glow Recipe’s final selection features diverse members of our community.
Selection of semi-finalists will take place throughout the Application Period and is scheduled to be completed on or around February 20, 2024. The Participants selected as semi-finalists (each, a “Semi-Finalist”) will be notified (as described below) during that time. The total number of Semi-Finalists selected by Glow Recipe shall be in Glow Recipe’s sole discretion. The decisions of Glow Recipe will be final and binding in all matters related to the Casting Call.
No drawings, sweepstakes, raffles, or other elements of chance are utilized to determine the Semi-Finalists or Selected Participants.
NOTIFICATION.
Glow Recipe will make up to two (2) attempts to notify each Semi-Finalist selected for an invitation to the Casting Interview via the email address associated with that Semi-Finalist’s application. Glow Recipe is not liable if the Semi-Finalist is not reached or receives such notification too late to attend any of days set aside for the Casting Interviews (i.e., February 26 – February 28, 2024). Glow Recipe requests that each Semi-Finalist please respond with a courtesy notification as to whether or not the Semi-Finalist will participate in the Casting Interview. Glow Recipe makes no representations or warranties that all Semi-Finalist will be able to participate in a Casting Interviews and reserves the right, in its sole discretion, to decide whether or not to invite additional Participants in the event any Semi-Finalist cannot or decline to attend a Casting Interview.
CASTING INTERVIEW.
Each Semi-Finalist will receive an invitation to attend a Casting Interview, which will set forth the exact time and instructions for participating in the Casting Interview. Every Semi-Finalist will be allowed to participate in a Casting Interview provided the Semi-Finalist is available at the time of the scheduled Casting Interview and has properly followed all provided instructions (i.e., logged on, with camera disabled). If you are a Semi-Finalist, please do not accept an invitation to the Casting Interview if you will not be available to attend the available time periods offered within the days set aside for such Casting Interviews (i.e., February 26 – February 28, 2024). Without limiting the foregoing, Semi-Finalists are solely responsible for their availability and ability to participate in the Casting Interview. Casting Interviews will be conducted via Google Hangout, so Semi-Finalists will have the option to join the Casting Interview by computer (with video disabled) or by phone using the provided dial-in information. All costs and expenses of participating in the Casting Interview are the sole responsibility of each Semi-Finalist. Glow Recipe is not liable in any way if a Semi-Finalist is not able to attend any Casting Interview at its designated time and location. THERE IS NO GUARANTEE THAT A SEMI-FINALIST WILL RECEIVE ANYTHING OTHER THAN THE RIGHT TO PARTICIPATE IN THE CASTING INTERVIEW. WITHOUT LIMITING THE FOREGOING, ALL PARTICIPANTS EXPRESSLY ACKNOWLEDGE THAT AN INVITATION TO A CASTING INTERVIEW DOES NOT ENSURE ANY SEMI-FINALIST WILL BE A PART OF ANY GLOW RECIPE CAMPAIGN OR IN ANY OTHER WAY BE INVOLVED IN OR ASSOCIATED WITH GLOW RECIPE. GLOW RECIPE MAY NOT USE ANY SEMI-FINALIST IN ANY CAMPAIGN AND MAY INSTEAD USE SOMEONE WHO DID NOT PARTICIPATE IN THE CASTING INTERVIEW.
CONDITIONS.
As a condition to participation in the Casting Interview, each Semi-Finalist may be required to execute an Affidavit of Eligibility, a Liability Release and/or a Publicity Release and/or Participation Agreement or Waiver, and/or other documents requested by Glow Recipe in its sole discretion, as well as parental or legal guardian consent, if applicable (collectively, "Affidavit/Release"). Such documents must be signed and returned in accordance with Glow Recipe’s instructions at the time of the Semi-Finalist’s invitation to the Casting Interview. If the documents are not signed and returned, or if a Semi-Finalist is found to be ineligible, or if a Semi-Finalist does not comply with these Terms, each as determined by Glow Recipe in Glow Recipe’s sole discretion, then the Semi-Finalist will be disqualified and not be allowed to participate in the Casting Interview.
SELECTED PARTICIPANTS.
Following the Casting Interviews, a panel of representatives from Glow Recipe will select a final set of Participants for proposed participation in the Campaign, along with an additional set of back-up Participants. The proposed Participants will be chosen without the panel of representatives from Glow Recipe having knowledge of the appearance of the Participants and without access to information in the Submission that might provide information about a Participant, their age, location, or ethnicity. These proposed Participants will be reviewed by Glow Recipe’s the members of Glow Recipe’s Diversity Advisory Board (each a “Advisory Partner”) to ensure that the final group chosen represents Glow Recipe’s diverse community of cultural backgrounds, skin tones, skin concerns, and ages. If, for any reason, the proposed Participants are determined by the Advisory Partners to lack sufficient diversity with respect to those characteristics, the Advisory Partners will help cast a more diverse group from the group of proposed and back-up Participants, until the final set of Participants have been selected as models to participate in the Campaign (the “Selected Participants”). The total number of Selected Participants selected by Glow Recipe shall be in Glow Recipe’s sole discretion. Selected Participants must be available for an on-camera video call to be informed of their selection. Glow Recipe requests that each Selected Participant please respond with a courtesy notification as to whether or not the Selected Participant will participate in the Campaign. Glow Recipe reserves the right, in its sole discretion, to decide whether or not to invite additional Semi-Finalists to participate in the Campaign in the event any Selected Participant cannot or declines to participate in the Campaign. As conditions of participating in the Campaign, each Selected Participant may be required to execute a non-disclosure agreement and/or other documents requested by Glow Recipe in its sole discretion. Such documents must be signed and returned in accordance with Glow Recipe’s instructions at the time such documents are delivered to the Selected Participant. If the documents are not signed and returned, or if a Selected Participant does not comply with these Terms, each as determined by Glow Recipe in Glow Recipe’s sole discretion, then the Selected Participant will be disqualified, will not be allowed to participate in the Campaign, and Glow Recipe may, in its sole discretion, select a new Participant from the Semi-Finalists. Additionally, all Selected Participants must be available at specified times during the period of March 24– March 25, 2024 to travel to Paris, France (if necessary) if a Selected Participant from the European Union or during the period of April 23- April 24, 2024 to New York City, NY (if necessary) if a Selected Participant from the US for a welcome dinner and to participate in the photo and video shoots for the Campaign. Selected Participants will be required to be available during the respective dates to participate in the photo and video shoots, with exact dates to be determined by Glow Recipe, in its sole discretion, for each Selected Participant. If a Selected Participant is not available to participate on these dates as required, then the Selected Participant will be disqualified, will not be allowed to participate in the Campaign, and Glow Recipe may, in its sole discretion, select a new Participant from the Semi-Finalists.
RELEASE.
By applying in connection with this Casting Call, all Participants agree to release, and hold harmless Glow Recipe, together with any and all of its Advisory Partners, and its and their respective parents, affiliates, subsidiaries, assigns, directors, officers, employees, and agents, including advertising and promotion agencies, and any other organizations/entities/persons related to the Casting Call (collectively, “Releasees”) harmless from any and all claims, injuries, damages, expenses, or losses to person or property and/or liabilities of any nature that in any way arise from participation in the Casting Call or Casting Interview, including without limitation (i) any condition caused by events beyond Releasees’ control that may cause the Casting Call or Casting Interview to be disrupted, postponed or cancelled; (ii) any injuries, losses, or damages (compensatory, direct, incidental, consequential, or otherwise) of any kind arising in connection with or as a result of participation in the Casting Call or Casting Interview other than those caused by the willful negligence or intentional misconduct of a Releasee; and, (iii) any printing or typographical errors in any materials associated with the Casting Call.
LIMITATION OF LIABILITY.
The Releasees are not responsible for: (i) late, lost, delayed, damaged, incomplete, illegible, misdirected, or undeliverable entries, responses, or other correspondence, whether by e-mail or postal mail or otherwise; (ii) theft, destruction, unauthorized access to or alterations of application materials; or, (iii) phone, electrical, network, computer, hardware, software program, or transmission malfunctions, failures or difficulties. The invitations to the Casting Interviews are awarded “as is, where is,” without warranty of any kind, express or implied. Except where prohibited, by participating in the Casting Call and submitting an application, each Participant agrees that: (a) any and all disputes, claims and causes of action arising out of or in connection with participation in a Casting Interview, determination of a Selected Participants, or any other matter relating to the Casting Call that cannot be resolved between such Participant and any Releasees shall be resolved individually, without resort to any form of class action; and, (b) any and all claims, judgments and awards shall be limited to the greater of: (1) actual out-of-pocket costs incurred, including costs associated with applying to the Casting Call, and (2) US $2,000. In no event will attorneys’ fees be awarded, unless otherwise required under applicable law. Notwithstanding anything to the contrary herein, in no event shall any Participant seek or be entitled to rescission, injunctive, or other equitable relief or to enjoin or restrain the production, distribution, exhibition, operation or other exploitation of Glow Recipe products or campaigns, the Casting Call, any website, content, advertising or other materials used, displayed or issued in connection with the Casting Call, or any submission or application, and such Participant’s rights and remedies in any such event shall be strictly limited to the right to recover money damages, if any, in an action at law. IN NO EVENT WILL ANY OF THE RELEASEES BE LIABLE FOR ANY DIRECT OR INDIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF USE, DATA, BUSINESS OR PROFITS) ARISING OUT OF OR IN CONNECTION WITH PARTICIPATION IN THE CASTING CALL, WHETHER SUCH LIABILITY ARISES FROM ANY CLAIM BASED UPON CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, AND WHETHER OR NOT SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO ALL PARTICIPANTS.TO THE EXTENT ANY LIMITATIONS OR EXCLUSIONS TO LIABILITY DESCRIBED ABOVE ARE NOT PERMISSIBLE IN YOUR JURISDICTION, SUCH LIMITATIONS AND/OR EXCLUSIONS WILL BE DEEMED MODIFIED TO COMPLY WITH THE APPLICABLE LAWS, RULES, OR REGULATIONS IN YOUR JURISDICTION.
GENERAL CONDITIONS.
By participating in the Casting Call, each Participant acknowledges that they have read these Terms and agree to be bound by them and by the decisions of Glow Recipe, which are final and binding on all matters pertaining to the Casting Call. Non-compliance with these Terms may result in disqualification and all associated entries will be void. Glow Recipe reserves the right, in its sole discretion and without liability to the Participant, to cancel, modify or suspend the Casting Call in whole or in part. Glow Recipe reserves the right to disqualify any Participant or Selected Participant, as determined by Glow Recipe, where Glow Recipe believes it is necessary and appropriate to do so, in its sole discretion and without liability to the Participant or Selected Participant. The Casting Call is subject to these Terms and Conditions and all applicable federal, state, provincial, and local laws, rules, and regulations. The Casting Call is void where prohibited or restricted by law. All disputes, issues and/or questions concerning the Casting Call, including the rights and obligations of the Participant and Glow Recipe in connection with the Casting Call, or the construction, validity, interpretation and enforceability of these Terms shall be governed by, and construed in accordance with the laws of the State of New York, United States without giving effect to any choice of law or conflict of law rules (whether of the State of New York, United States or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York, United States. Any legal actions, suits or proceedings related to the Casting Call (whether for breach of contract, tortious conduct or otherwise) will be brought exclusively in the state or federal courts located in New York, New York, United States. Each Participant accepts and submits to the personal jurisdiction of such courts with respect to any legal actions, suits or proceedings arising out of or related to the Casting Call. Glow Recipe disclaims any responsibility to notify Participants of any aspect related to the conduct of the Casting Call.
FORCE MAJEURE.
Without limiting any other provision in these Terms, in the event that any of the Participants’ activities or the Releasees’ operations or activities are affected for reasons outside of their control, as determined by Glow Recipe, in its sole discretion, including, without limitation, by reason of any acts of God, any action, regulation, order or request by any governmental or quasi-governmental entity (whether or not the action, regulations, order or request proves to be invalid), equipment failure, threatened terrorist acts, terrorist acts, air raid, blackout, act of public enemy, earthquake, war (declared or undeclared), fire, flood, epidemic or public health crisis (e.g., SARS, COVID-19, etc.), explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal) labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any law, rule, regulation, order or other action adopted or taken by any governmental, federal, state or local government authority, or any other cause, whether or not specifically mentioned above, subject to any governmental approval that may be required, Glow Recipe shall have the right to modify, suspend, or terminate the Casting Call, and no Releasees shall be responsible or liable to any Participant or Selected Participant or any person claiming through such Participant or Selected Participant for failure to hold any Casting Interviews. Glow Recipe is not responsible for electronic communications that are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in Participant’s e-mail account to receive e-mail messages.
MISCELLANEOUS.
The invalidity or unenforceability of any provision of these Terms shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Terms shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Glow Recipe’s failure to (or decision not to) enforce any provision in these Terms shall not constitute a waiver of that or any other provision. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Casting Call-related materials and these Terms, these Terms shall prevail, govern, and control and the discrepancy will be resolved in Glow Recipe’s sole and absolute discretion.
For the avoidance of doubt, the Advisory Partners are not administrators of the Casting Call and are in no way responsible for the administration of the Casting Call. THIS CASTING CALL DOES NOT GUARANTEE THAT ANY PARTICIPANT WILL BE INVITED TO ANY FURTHER CALLS WITH GLOW RECIPE OR ANY ADVISORY PARTNER (DEFINED BELOW) OR TO PARTICIPATE IN THE CAMPAIGN. YOU UNDERSTAND AND AGREE THAT SPONSOR HAS THE RIGHT TO SELECT ANY PARTICIPANT IT CHOOSES (IF ANY) TO INVITE TO ANY CALLS WITH GLOW RECIPE AND/OR ANY OTHER ADVISORY PARTNER(S) AND/OR TO PARTICIPATE IN THE CAMPAIGN.
GENERAL INFORMATION.
The application period for this Casting Call opens at 12:00.00 PM EST on January 26, 2024 and ends at 11:59.59 PM EST on February 5, 2024 (the “Application Period”).
HOW TO APPLY.
During the Application Period, each participant (the “Participant”) must visit the application page at [https://glowrecipe.typeform.com/USapplication] (“Site”) if a resident of the continental US, or at [https://glowrecipe.typeform.com/EUapplication] (“Site”) if a resident of the European Union and submit all information requested in the application questionnaire, which includes your name, e-mail address, age, city and state and/or country of residence, ethnicity, and other information about you (“Application Information”). All Application Information and other information submitted by participant shall be collectively referred to herein as the “Submissions” or each a “Submission.” Limit one (1) Submission per person. No other method of participation will be accepted. Submissions that do not follow the requirements of these Terms may be disqualified at Glow Recipe’s discretion.
All deadlines are based on the Eastern Standard Time. All determinations of eligibility shall be final and binding. For the avoidance of doubt, Glow Recipe may or may not provide Participants with confirmation of Casting Call application.
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO APPLY OR BE ELIGIBLE TO RECEIVE A CALL BACK AND MAKING A PURCHASE OR OTHER PAYMENT TO GLOW RECIPE DOES NOT INCREASE YOUR LIKELIHOOD OF BEING SELECTED TO PARTICIPATE IN THE CAMPAIGN.
APPLICATION INFORMATION CONDITIONS AND RESTRICTIONS.
Glow Recipe will only use your Application Information to contact you for reasons relating to this Casting Call and otherwise in accordance with Glow Recipe’s privacy policy at https://www.glowrecipe.com/pages/privacy-policy. Please review these Terms and the Privacy Policy that carefully.
By participating in the Casting Call, you hereby agree to Glow Recipe’s collection and usage of any personal information included in the Submission for the purposes described above and acknowledge that you have read and accepted Glow Recipe’s privacy policy. Please note that information about your racial or ethnic origin is considered a special category of personal data under certain privacy laws. If you provide or disclose any information about your sexuality or sexual orientation, that information is also considered a special category of personal data under applicable privacy laws. By providing the requested Application Information, you agree that you are explicitly consenting to the processing of that personal data for the purposes described in these Terms.
SEMI-FINALIST DETERMINATION.
The decision as to which Participants will receive an invitation for an off-camera call as a semi-finalist will be made as follows:
A panel of representatives from Glow Recipe will review all Submissions properly submitted and received during the Application Period. The panel will choose Participants to invite to participate in a Casting Interview, in its sole discretion, taking into account only the information provided by the Participants in the Submissions. The Participants who are selected as the semi-finalists will be required to provide a photo (“Photo”) of themselves through a secure method that prevents the representatives from Glow Recipe from seeing the Photo. Instructions with respect to the required Photo and how to submit it will be provided at or around the time the Participants are invited for a Casting Interview, but Participants should expect to provide a headshot, looking straight into the camera, with a plain background, even lighting, and in .jpg/.jpeg format no larger than 3MB. When received, Glow Recipe will not use your Photo for any purpose other than evaluating your Submission, through the Advisory Partners, for ensuring that Glow Recipe’s final selection features diverse members of our community.
Selection of semi-finalists will take place throughout the Application Period and is scheduled to be completed on or around February 20, 2024. The Participants selected as semi-finalists (each, a “Semi-Finalist”) will be notified (as described below) during that time. The total number of Semi-Finalists selected by Glow Recipe shall be in Glow Recipe’s sole discretion. The decisions of Glow Recipe will be final and binding in all matters related to the Casting Call.
No drawings, sweepstakes, raffles, or other elements of chance are utilized to determine the Semi-Finalists or Selected Participants.
NOTIFICATION.
Glow Recipe will make up to two (2) attempts to notify each Semi-Finalist selected for an invitation to the Casting Interview via the email address associated with that Semi-Finalist’s application. Glow Recipe is not liable if the Semi-Finalist is not reached or receives such notification too late to attend any of days set aside for the Casting Interviews (i.e., February 26 – February 28, 2024). Glow Recipe requests that each Semi-Finalist please respond with a courtesy notification as to whether or not the Semi-Finalist will participate in the Casting Interview. Glow Recipe makes no representations or warranties that all Semi-Finalist will be able to participate in a Casting Interviews and reserves the right, in its sole discretion, to decide whether or not to invite additional Participants in the event any Semi-Finalist cannot or decline to attend a Casting Interview.
CASTING INTERVIEW.
Each Semi-Finalist will receive an invitation to attend a Casting Interview, which will set forth the exact time and instructions for participating in the Casting Interview. Every Semi-Finalist will be allowed to participate in a Casting Interview provided the Semi-Finalist is available at the time of the scheduled Casting Interview and has properly followed all provided instructions (i.e., logged on, with camera disabled). If you are a Semi-Finalist, please do not accept an invitation to the Casting Interview if you will not be available to attend the available time periods offered within the days set aside for such Casting Interviews (i.e., February 26 – February 28, 2024). Without limiting the foregoing, Semi-Finalists are solely responsible for their availability and ability to participate in the Casting Interview. Casting Interviews will be conducted via Google Hangout, so Semi-Finalists will have the option to join the Casting Interview by computer (with video disabled) or by phone using the provided dial-in information. All costs and expenses of participating in the Casting Interview are the sole responsibility of each Semi-Finalist. Glow Recipe is not liable in any way if a Semi-Finalist is not able to attend any Casting Interview at its designated time and location. THERE IS NO GUARANTEE THAT A SEMI-FINALIST WILL RECEIVE ANYTHING OTHER THAN THE RIGHT TO PARTICIPATE IN THE CASTING INTERVIEW. WITHOUT LIMITING THE FOREGOING, ALL PARTICIPANTS EXPRESSLY ACKNOWLEDGE THAT AN INVITATION TO A CASTING INTERVIEW DOES NOT ENSURE ANY SEMI-FINALIST WILL BE A PART OF ANY GLOW RECIPE CAMPAIGN OR IN ANY OTHER WAY BE INVOLVED IN OR ASSOCIATED WITH GLOW RECIPE. GLOW RECIPE MAY NOT USE ANY SEMI-FINALIST IN ANY CAMPAIGN AND MAY INSTEAD USE SOMEONE WHO DID NOT PARTICIPATE IN THE CASTING INTERVIEW.
CONDITIONS.
As a condition to participation in the Casting Interview, each Semi-Finalist may be required to execute an Affidavit of Eligibility, a Liability Release and/or a Publicity Release and/or Participation Agreement or Waiver, and/or other documents requested by Glow Recipe in its sole discretion, as well as parental or legal guardian consent, if applicable (collectively, "Affidavit/Release"). Such documents must be signed and returned in accordance with Glow Recipe’s instructions at the time of the Semi-Finalist’s invitation to the Casting Interview. If the documents are not signed and returned, or if a Semi-Finalist is found to be ineligible, or if a Semi-Finalist does not comply with these Terms, each as determined by Glow Recipe in Glow Recipe’s sole discretion, then the Semi-Finalist will be disqualified and not be allowed to participate in the Casting Interview.
SELECTED PARTICIPANTS.
Following the Casting Interviews, a panel of representatives from Glow Recipe will select a final set of Participants for proposed participation in the Campaign, along with an additional set of back-up Participants. The proposed Participants will be chosen without the panel of representatives from Glow Recipe having knowledge of the appearance of the Participants and without access to information in the Submission that might provide information about a Participant, their age, location, or ethnicity. These proposed Participants will be reviewed by Glow Recipe’s the members of Glow Recipe’s Diversity Advisory Board (each a “Advisory Partner”) to ensure that the final group chosen represents Glow Recipe’s diverse community of cultural backgrounds, skin tones, skin concerns, and ages. If, for any reason, the proposed Participants are determined by the Advisory Partners to lack sufficient diversity with respect to those characteristics, the Advisory Partners will help cast a more diverse group from the group of proposed and back-up Participants, until the final set of Participants have been selected as models to participate in the Campaign (the “Selected Participants”). The total number of Selected Participants selected by Glow Recipe shall be in Glow Recipe’s sole discretion. Selected Participants must be available for an on-camera video call to be informed of their selection. Glow Recipe requests that each Selected Participant please respond with a courtesy notification as to whether or not the Selected Participant will participate in the Campaign. Glow Recipe reserves the right, in its sole discretion, to decide whether or not to invite additional Semi-Finalists to participate in the Campaign in the event any Selected Participant cannot or declines to participate in the Campaign. As conditions of participating in the Campaign, each Selected Participant may be required to execute a non-disclosure agreement and/or other documents requested by Glow Recipe in its sole discretion. Such documents must be signed and returned in accordance with Glow Recipe’s instructions at the time such documents are delivered to the Selected Participant. If the documents are not signed and returned, or if a Selected Participant does not comply with these Terms, each as determined by Glow Recipe in Glow Recipe’s sole discretion, then the Selected Participant will be disqualified, will not be allowed to participate in the Campaign, and Glow Recipe may, in its sole discretion, select a new Participant from the Semi-Finalists. Additionally, all Selected Participants must be available at specified times during the period of March 24– March 25, 2024 to travel to Paris, France (if necessary) if a Selected Participant from the European Union or during the period of April 23- April 24, 2024 to New York City, NY (if necessary) if a Selected Participant from the US for a welcome dinner and to participate in the photo and video shoots for the Campaign. Selected Participants will be required to be available during the respective dates to participate in the photo and video shoots, with exact dates to be determined by Glow Recipe, in its sole discretion, for each Selected Participant. If a Selected Participant is not available to participate on these dates as required, then the Selected Participant will be disqualified, will not be allowed to participate in the Campaign, and Glow Recipe may, in its sole discretion, select a new Participant from the Semi-Finalists.
RELEASE.
By applying in connection with this Casting Call, all Participants agree to release, and hold harmless Glow Recipe, together with any and all of its Advisory Partners, and its and their respective parents, affiliates, subsidiaries, assigns, directors, officers, employees, and agents, including advertising and promotion agencies, and any other organizations/entities/persons related to the Casting Call (collectively, “Releasees”) harmless from any and all claims, injuries, damages, expenses, or losses to person or property and/or liabilities of any nature that in any way arise from participation in the Casting Call or Casting Interview, including without limitation (i) any condition caused by events beyond Releasees’ control that may cause the Casting Call or Casting Interview to be disrupted, postponed or cancelled; (ii) any injuries, losses, or damages (compensatory, direct, incidental, consequential, or otherwise) of any kind arising in connection with or as a result of participation in the Casting Call or Casting Interview other than those caused by the willful negligence or intentional misconduct of a Releasee; and, (iii) any printing or typographical errors in any materials associated with the Casting Call.
LIMITATION OF LIABILITY.
The Releasees are not responsible for: (i) late, lost, delayed, damaged, incomplete, illegible, misdirected, or undeliverable entries, responses, or other correspondence, whether by e-mail or postal mail or otherwise; (ii) theft, destruction, unauthorized access to or alterations of application materials; or, (iii) phone, electrical, network, computer, hardware, software program, or transmission malfunctions, failures or difficulties. The invitations to the Casting Interviews are awarded “as is, where is,” without warranty of any kind, express or implied. Except where prohibited, by participating in the Casting Call and submitting an application, each Participant agrees that: (a) any and all disputes, claims and causes of action arising out of or in connection with participation in a Casting Interview, determination of a Selected Participants, or any other matter relating to the Casting Call that cannot be resolved between such Participant and any Releasees shall be resolved individually, without resort to any form of class action; and, (b) any and all claims, judgments and awards shall be limited to the greater of: (1) actual out-of-pocket costs incurred, including costs associated with applying to the Casting Call, and (2) US $2,000. In no event will attorneys’ fees be awarded, unless otherwise required under applicable law. Notwithstanding anything to the contrary herein, in no event shall any Participant seek or be entitled to rescission, injunctive, or other equitable relief or to enjoin or restrain the production, distribution, exhibition, operation or other exploitation of Glow Recipe products or campaigns, the Casting Call, any website, content, advertising or other materials used, displayed or issued in connection with the Casting Call, or any submission or application, and such Participant’s rights and remedies in any such event shall be strictly limited to the right to recover money damages, if any, in an action at law. IN NO EVENT WILL ANY OF THE RELEASEES BE LIABLE FOR ANY DIRECT OR INDIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF USE, DATA, BUSINESS OR PROFITS) ARISING OUT OF OR IN CONNECTION WITH PARTICIPATION IN THE CASTING CALL, WHETHER SUCH LIABILITY ARISES FROM ANY CLAIM BASED UPON CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, AND WHETHER OR NOT SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO ALL PARTICIPANTS.TO THE EXTENT ANY LIMITATIONS OR EXCLUSIONS TO LIABILITY DESCRIBED ABOVE ARE NOT PERMISSIBLE IN YOUR JURISDICTION, SUCH LIMITATIONS AND/OR EXCLUSIONS WILL BE DEEMED MODIFIED TO COMPLY WITH THE APPLICABLE LAWS, RULES, OR REGULATIONS IN YOUR JURISDICTION.
GENERAL CONDITIONS.
By participating in the Casting Call, each Participant acknowledges that they have read these Terms and agree to be bound by them and by the decisions of Glow Recipe, which are final and binding on all matters pertaining to the Casting Call. Non-compliance with these Terms may result in disqualification and all associated entries will be void. Glow Recipe reserves the right, in its sole discretion and without liability to the Participant, to cancel, modify or suspend the Casting Call in whole or in part. Glow Recipe reserves the right to disqualify any Participant or Selected Participant, as determined by Glow Recipe, where Glow Recipe believes it is necessary and appropriate to do so, in its sole discretion and without liability to the Participant or Selected Participant. The Casting Call is subject to these Terms and Conditions and all applicable federal, state, provincial, and local laws, rules, and regulations. The Casting Call is void where prohibited or restricted by law. All disputes, issues and/or questions concerning the Casting Call, including the rights and obligations of the Participant and Glow Recipe in connection with the Casting Call, or the construction, validity, interpretation and enforceability of these Terms shall be governed by, and construed in accordance with the laws of the State of New York, United States without giving effect to any choice of law or conflict of law rules (whether of the State of New York, United States or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York, United States. Any legal actions, suits or proceedings related to the Casting Call (whether for breach of contract, tortious conduct or otherwise) will be brought exclusively in the state or federal courts located in New York, New York, United States. Each Participant accepts and submits to the personal jurisdiction of such courts with respect to any legal actions, suits or proceedings arising out of or related to the Casting Call. Glow Recipe disclaims any responsibility to notify Participants of any aspect related to the conduct of the Casting Call.
FORCE MAJEURE.
Without limiting any other provision in these Terms, in the event that any of the Participants’ activities or the Releasees’ operations or activities are affected for reasons outside of their control, as determined by Glow Recipe, in its sole discretion, including, without limitation, by reason of any acts of God, any action, regulation, order or request by any governmental or quasi-governmental entity (whether or not the action, regulations, order or request proves to be invalid), equipment failure, threatened terrorist acts, terrorist acts, air raid, blackout, act of public enemy, earthquake, war (declared or undeclared), fire, flood, epidemic or public health crisis (e.g., SARS, COVID-19, etc.), explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal) labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any law, rule, regulation, order or other action adopted or taken by any governmental, federal, state or local government authority, or any other cause, whether or not specifically mentioned above, subject to any governmental approval that may be required, Glow Recipe shall have the right to modify, suspend, or terminate the Casting Call, and no Releasees shall be responsible or liable to any Participant or Selected Participant or any person claiming through such Participant or Selected Participant for failure to hold any Casting Interviews. Glow Recipe is not responsible for electronic communications that are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in Participant’s e-mail account to receive e-mail messages.
MISCELLANEOUS.
The invalidity or unenforceability of any provision of these Terms shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Terms shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Glow Recipe’s failure to (or decision not to) enforce any provision in these Terms shall not constitute a waiver of that or any other provision. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Casting Call-related materials and these Terms, these Terms shall prevail, govern, and control and the discrepancy will be resolved in Glow Recipe’s sole and absolute discretion.
For the avoidance of doubt, the Advisory Partners are not administrators of the Casting Call and are in no way responsible for the administration of the Casting Call.
